Private Charters Terms & Conditions
This agreement is for the charter of a vessel, operated by Wild West Charters and covers the rights and obligations of the Parties.
Wild West Charters is a supplier of recreational services and activities, including but not limited to private touring, charter fishing, boating experiences and associated activities. The following terms and conditions apply to all charter bookings with Wild West Charters, whether you make a booking over the telephone, via email, our online booking facility, or by any other means.
By making a booking you confirm that you have read, understood, accepted, and agree to be unconditionally bound to these terms and conditions contained herein.
Wild West Charters reserves the right to cancel Charters that are in breach of our terms and conditions.
1. Charter Proposal & Quotations
i. A charter proposal & quote are only valid for 28 days from the date of consultation or otherwise subject to availability of the Vessel at the time of confirmation.
ii. A minimum of 2-hour cruise is applicable to all private bookings.
iii. Payment of the deposit in accordance with the confirmed booking constitutes your acceptance of the Terms and Conditions.
2. Pricing
i. All prices are shown in Australian Dollars plus GST unless specified.
ii. The Charter price includes the cost of the Vessel, crew, all other cost related to operations of the Charter such as fuel, landing fee and standby fee. Standby fee is $100 per hour. Island Admission fees only apply to Rottnest Island

iii. Delivery fee for re-location of vessel (that is outside of our registered commercial berths) is $500 one-way.
iv. The price is only guaranteed once paid for in full by you.
3. Tentative Reservations
i. Tentative reservations may be held for up to 1 week pending payment of a deposit, or until another party wants to book the same Vessel, whichever is sooner.
ii. The booking is not secured until a deposit, initialled and signed Charter Confirmation has been received by us.
4. Payments
i. The non-refundable deposit payable to confirm the booking will be 20% of the Charter fee available during the validity of your quote.
ii. Final guest number and payment in full is required for all bookings 24 hours prior to departure. We reserve our right to cancel a reservation where the required payment has not been made. In such events, you will forfeit any deposit paid.
iii. Last minute additions to bookings are also required to be paid in full at least 24 hours prior to the time of departure of the charter and are fully subject to availability.
iv. Payments via direct deposit are preferred. Credit card or Australian Dollar cash payments are also accepted. We do not accept American Express.
5. Cancellation Policy
i. All requests for cancellation must be sent in writing to contact@wildwestcharters.com.au
ii. All bookings to secure a Wild West Vessel is strictly non-refundable for changes of mind, change of experience to a lesser value or cancellations by you (subject to your rights under Australian Consumer Law).
iii. Any changes in date for the for Charters booked must be made with us at least 10 business days prior to the Charter’s date of the original booking. A reschedule date will need to be organised and agreed in writing based on Vessel’s availability.
iv. Once the Vessel has departed, no refund will be provided for shortened trips that may have been either requested by clients of a private charter, or as per Skipper’s decision due to safety or extraneous circumstances.
v. If we or the Operator cancels the Charter, whether it’s inclement weather or mechanical breakdowns, a full refund will be given and we have no further liability to you for such cancellation.
6. Bond
i. For a private charter of the Vessel, you will be required to pay a $250 refundable security bond at the time of booking for any damage cost to the vessel by your guests. This will be indicated on your invoice.
ii. Should there be any excessive cleaning, any breakages requiring replacement or repair including but not limited to any fixtures and fittings, the Operator will deduct the cost of repairs from the bond paid toward the Charter. If there is no damage to the Vessel, your bond will be refunded within 7 working days after the Charter cruise date.
7. Charter Extension & Additional Charges
i. The guest numbers may increase if agreed by you and the Operator. Additional charge may occur if it results in an upgrade of Vessel. No refund will be given if the actual number of guests is less than the intended guest number.
ii. The duration of the Charter includes the time taken to embark and disembark members of your Group. This is limited to one point of embarkation and one point of disembarkation unless otherwise agreed in writing.
iii. The Operator is not responsible for any delays caused by the late arrival of members of your Group, delays at the wharf caused by crowds, the arrival of other vessels or any other item beyond the Operator’s control.
iv. The course to be undertaken may be agreed in advance with the Operator or with the skipper. The Operator or skipper reserves the right to vary the agreed course because of weather, swells, traffic, vessel survey restrictions, or any other cause which the Operator or skipper believes is justified in the interests of the comfort or safety of passengers, crew, the Vessel and other vessels.
v. A Charter may be extended on the day of the Charter. You must pay for any extension based on the hourly rates as specified. This must be paid to the Operator prior to the departure.
8. Inclement Weather
i. In the event the conditions are considered to be unsafe, we reserve the right to reschedule charters up until the intended departure time. All effort is made to give as much prior notice of reschedule as possible, but no liability is accepted for inconvenience or last-minute change of charter plans by Wild West Charters.
ii. A full refund or reschedule within 3 months of the reservation is available for the individual booking.
9. Damage to Vessels
i. Should any damages, including interior or exterior furnishings, fixtures and fittings, caused by the charterer’s group be greater than the authorised bond amount, the Party agrees to pay for all costs and associated labour work involved. An invoice is to be sent to the client on the first business day after the Charter cruise date.
ii. Unruly behaviour, by members of the Charter’s Group, to the extent that the Master, in his sole discretion, in the interests of the safety of the Vessel and other passengers and its crew, may result in the decision of the Master that the Charter must be terminated early.
10. Liability & Indemnity
i. Wild West Charters will not be held liable for any indirect costs incurred by booking a charter with us. In the event the trip is rescheduled or cancelled at any time, we will not be held liable for any travel costs, meals, accommodation, or any other costs the customer may have incurred.
ii. You agree to indemnify and hold harmless us, the Operator and employees, from and against any and all losses, claims, actions, costs, expenses, fees, damages, fines and liabilities caused by any negligent act or omission by you or members of your Group including:
- Failure to follow any reasonable direction given by the captain or crew
- Failure to comply with any of these Terms and Conditions;
- Failure to comply with any warning sign;
- Unreasonable or unsafe behaviour;
- Wilful misuse of the equipment or facilities of the Vessel;
- Intoxication or the use of prohibited drugs;
- Bringing any weapons including firearms onto the Vessel.
